Healthcare Worker Sentenced to Two Decades for Intentional Insulin Overdose Leading to Elderly Patient's Death

May 30, 2025, 15:58

In a landmark judgment, the Provincial Court of León sentenced a nurse to 20 years of imprisonment for the calculated murder of a 98-year-old resident through an insulin overdose. The tragic incident unfolded during the summer of 2022, at a nursing home in León, following an altercation between the healthcare worker and the elderly victim. Allegations surfaced that the nurse had physically assaulted the patient, striking her head multiple times before administering the lethal injection.

The trial, held with a popular jury, concluded with a definitive verdict of guilt, compelling the accused to pay 50,000 euros in damages. Initially, the prosecution sought a harsher sentence of life imprisonment, which was ultimately reduced. Detailed court proceedings in early May 2023 sought to uncover the series of events at the Virgen del Camino nursing home.

On August 17, the convicted nurse was on duty and attended to Jesusa, a 98-year-old with severe dementia and high dependency needs. Court testimonies and witness accounts established that the nurse struck Jesusa on the head while assisting her with bedtime preparations. The following morning, caregivers noticed Jesusa's critical condition; she exhibited low oxygen levels, frequent apneas, and minimal response to stimuli. Emergency services transported her to León Hospital in a comatose state, where she was diagnosed with insulin intoxication, an unusual metabolic encephalopathy given her non-diabetic status.

Jesusa remained hospitalized for several weeks, ultimately passing away on September 4 due to the intentional insulin overdose. Throughout the trial, the nurse denied any involvement, refuting claims of physical assault or unauthorized access to insulin. Despite her defense, the popular jury, comprising nine citizens, overwhelmingly found her guilty.

The investigation further uncovered that the nurse possessed a piece of jewelry belonging to the deceased, which she admitted to acquiring improperly. The court's ruling mandates 20 years of incarceration, compensation of 50,000 euros, and an additional fine of 360 euros.
