Sony Ordered to Compensate Customer for Faulty Phone and Replacement Costs

Sony Mobile Communications Iberia S.L. faces a significant legal decision from the Madrid First Instance Court 67, which upholds consumer rights against unfair warranty practices. The company is ordered to repay a customer 699 euros for a faulty phone and 180 euros for the purchase of a second phone due to the company's failure to resolve the issue.

On March 31, 2025, the court responded positively to the client's lawsuit, represented by Legalion Abogados. The customer had bought the phone in December 2015 from Sony's official website, with a warranty offering extended coverage for repair, replacement, or reimbursement if the product did not meet specifications.

However, within a year, the phone's charging unit malfunctioned. Sony refused warranty service, claiming the customer had damaged the phone, which was allegedly received "bent." The judge dismissed this claim as unjustified.

Mario Rodríguez López, the attorney who achieved this legal victory, emphasized the ruling's affirmation of consumer rights against brand warranty abuses. He noted, "Brands often blame consumers for misuse, but this case clearly involves a manufacturing defect."

During court proceedings, attempts for an out-of-court settlement were made. Sony offered a replacement phone, but the deal fell through when the provided device was substandard: not new, in an unsealed box, lacking manuals, cables, and warranty. The client immediately rejected it.

The judge deemed this offer as a substantial breach of warranty related to the original purchase.

The judgment stresses Sony's obligation to honor the extended warranty, entitling the customer to a compliant product or compensation for incurred damages. Rodríguez López remarked, "Sony's inadequate proposal was astonishing, forcing the customer to buy another mobile, and that expense was also acknowledged."

The customer initially sought a fully repaired phone under warranty or reimbursement of the 699 euros paid, or return of the phone without repair and compensation for repair costs estimated at around 430 euros.

Ultimately, the court mandated not only the refund for the defective phone (699 euros) but also for the second phone (180 euros) purchased as a temporary solution. This decision strengthens the principle of complete damage repair and could set a precedent for future warranty claims. The plaintiff's lawyer concluded, "The ruling advances consumer legal protection by recognizing both the original defect and the additional harm caused by the brand's failure."
